Facing ATO action, Elite Sports Apparel has voluntarily entered administration, with director seeking ways to repay creditors as insolvency experts Mitchell Ball and Gavin King take charge.
The Sydney-based manufacturer, which has been supplying custom sports uniforms and workwear since 2013, faces ATO winding-up proceedings, according to joint administrators Mitchell Ball and Gavin King of Mackay Goodwin. They were appointed on October 27 via an ASIC insolvency notice.
Ball said the tax debt amount remains undisclosed, but confirmed the administration is in its early stages with more financial details expected next week. The company’s future remains uncertain, though the director is reportedly considering a Deed of Company Arrangement (DOCA) to distribute funds to creditors more quickly than liquidation would allow.
Under a DOCA, a legally binding agreement between the company and its creditors can provide an alternative to liquidation, potentially allowing continued trading while addressing debts. Ball indicated the business could also be sold through asset purchases or a third-party restructuring proposal. Continuity, he said, would depend on either a DOCA or an acquisition.
Elite Sports Apparel specializes in custom sports uniforms, workwear, and corporate clothing for sporting clubs, schools, and businesses. Its Australian manufacturing operation in Condell Park, Sydney’s southwest, prints, cuts, and sews garments in-house. The company also offers embroidery, screen printing, and digital fabric printing services, with offices in New Zealand and Fiji. It has marketed its Australian production as a faster alternative to overseas manufacturing.
The number of employees affected, outstanding debts, and fate of pending orders remain unclear. Administrators aim to maximize creditor returns, though the extent of any repayments is unknown at this early stage. Elite Sports Apparel declined to comment when contacted by SmartCompany.
A DOCA represents a strategic alternative for small businesses seeking to avoid liquidation while addressing creditor claims. This approach allows trading to continue under revised terms, potentially preserving jobs and customer relationships. For Elite Sports Apparel, such a structure could help maintain its regional manufacturing advantage while restructuring its financial obligations. The company’s ability to secure creditor approval for a DOCA will likely depend on demonstrating a viable path to debt resolution.
